Before starting your medical malpractice case, the judge wants to know how many witnesses each side is bringing in to testify. He wants to know when each witness is scheduled to testify.
After learning of our initial schedule of witnesses, the judge tells us that he will not have court on Wednesday morning because that's when he has to deal with the other cases he's handling. "Schedule your witnesses accordingly," he says.
Now in the middle of trial, my medical expert notifies me that he can no longer come into court on Tuesday because he now has to perform emergency surgery. This is life or death. I immediately notify my opponent. I immediately notify the judge.
It's unclear what the judge will do.
Will he allow me to continue with other witnesses?
Will he prevent me from going forward because I already promised the court that he'd be coming in to testify on that day?
