In this video I’m gonna be looking at whether or not fault drivers from road traffic accidents should also be able to claim compensation. If an accident occurs, in most circumstances, said accident happened because someone acted with negligence and was therefore at fault – this principal applies to the majority of road traffic accidents. Now those who weren’t at fault, the victims in the accident, they may be able to claim compensation but what about the person who caused the accident?
Well if they are only partially to blame for the accident and another external factor also contributed to the accident occurring then they may be able to claim compensation. But what if that wasn’t the case, what if they were to solely to blame, should they be able to claim?
When bringing a claim for compensation, in most cases, a claimant is claiming against the fault party’s insurance policy, if the fault driver wished to make a claim, who would they be claiming against? Even if the fault driver has comprehensive car insurance, they may only be able to claim the cost of repair of their own vehicle from the insurer, which may also be subject to an excess as well as have impact their no claims discount.
So this is how things currently stand, but should a fault driver be able to claim compensation for their injuries?
It’s most likely for the best that fault drivers can’t claim compensation. Whilst we understand that being involved in a road traffic accident can mean that you’re out of pocket due to time off work and medical costs, if the accident was your fault, then you shouldn’t be able to claim. Not only would this lead to a huge increase in fraud cases, as insures may argue that an accident was in fact intentional in order to make a claim. It would almost certainly make the cost of car insurance go up and potentially even make people more careless when out on the roads.
