Hi, my name is Nicole and I am an immigration adviser at LexLegal. Today, I am going to speak about Brexit and what will happen after Brexit. At this stage we thought we will have some information and some more clarity, but it is not the case we are at the beginning of November and Brexit Still did not happen.
So far, it was granted a new extension which will be until the 31st of January 2020. It is actually more a flextension so there is still the possibility that Brexit may happen earlier but is little bit unlikely. We will have a general election on the 12 December 2019, and this may determine the outcome of Brexit. Many people that given the Johnson’s new proposal of deal, the elections and the new extension there is no possibility of a Brexit without a deal. Unfortunately, this is not the case, it is likely we will have a deal but there is no certainty yet.What will happen next? All the EU citizens and their family members which are in the UK can apply for the Settlement scheme so they will have the right to work, study and use the NHS after the Brexit. As explained in our previous video they can be granted either settled or pre settled status; the settled status does not have any limit in time, while the pre-settled it is granted for 5 years after which EU citizens will be able to switch to the settled status. After a year with this indefinite leave to remain (settled status) they will be able to apply for citizenship.What will happen with those Europeans citizens that will happen after the Brexit day (31st of January 2020 so far as we know). They will have to apply for a new system which is EU TLR. The system will allow to stay for 36 months, so it is a limited leave and it is a quite simple application; after they will be able to switch to a point based system which as far as we know the government will propose a new point based system which will be similar to the Australian one and all the EU citizens with the EU TLR once expired will have to apply under the new point based system. If they will not qualify then unfortunately, they will have to leave the UK. We still do not have much details about this system, so as soon as we will have some more information of course we will let you know. Recently, we have received many enquiries especially family member of EU citizens; they are quite worried about how they can join now their family members. They can still choose to apply with EEA family permit or with the EU Settlement Scheme family permit. In some circumstances, it is still more convenient to apply via the old EEA family permit, for example when the EU citizen in the UK did not yet apply for settlement scheme so they don’t have a status or a reference number; as well in case of extended family members and children over 21 years old also could be partners, uncles, old term partners they are all advised to do it via the Family permit which will be granted for 6 months and once here be able to apply for the settlement scheme so continue living with their family member.If on the contrary the EU citizen have applied already for the settlement scheme and they have been granted a status then the family member can apply to join via the EUSS family permit which is a little bit I may say easier than the family permit, you do not need as much evidences. This will also be granted for 6 months and once in the UK they can switch to settlement scheme.All the family members like spouses, children, dependent children over 21 years old could be also extended family members of EU citizens which are in the UK before the 31st of January 2020, will be able to apply for the settlement scheme and leave here with their family members if they meet the requirements. They will have time at least until the end of 2020 to apply.
In case of EU citizens after the Brexit (31 of January 2020) then their family members together with the EU citizens they will be able to stay until at least the end of 2020 without any formal changes but they will have time only until December 2020 to apply for the new scheme EU TLR, As far as we know it will be an easy application which will check the identity, criminal record and some other formalities for example the family members will need to give their biometrics but nothing too difficult.
